Terms and Conditions of Use

Purpose

The purpose of these Terms and Conditions of Use is to define the terms and conditions under which the company SCHRADER makes the website www.schrader.fr, a non-commercial website, available, and the conditions of use of the Site by the User.

Any connection to the Site is subject to compliance with these conditions.

For the User, the simple fact of accessing the Site at the following URL http://www.schrader.fr implies the unreserved acceptance of all of the Terms and Conditions described hereafter.

Definitions

Email: a personal address for receiving email messages.

SCHRADER: the company Schrader SAS and its affiliates.

Site: the www.schrader.fr website.

User: any person who uses the Site or any of the services offered on the Site.

Accessing the Site

SCHRADER endeavours to ensure the best possible access to the Site, and to this end access may be interrupted for maintenance. In addition, access to the Site may be exceptionally interrupted in the case of force majeure or an event beyond SCHRADER’s control, and subject to possible breakdowns and other maintenance interventions necessary for the proper functioning of the Site and its services.

Consequently, SCHRADER cannot guarantee the availability of the Site and/or services, transmission reliability, or performance in terms of response time or quality.

SCHRADER cannot be held liable in the event that it is impossible to access this Site and/or use the services therein.

In addition, SCHRADER may interrupt the Site or any part of the services at any time without notice, without the right to compensation, and without SCHRADER being held liable for this reason.

Use of the Site and the services requires an Internet connection. The equipment and connection costs cannot be attributed in any way to SCHRADER.

Responsibility

SCHRADER undertakes to do everything in its power to provide the User with verified and updated information, but cannot be held responsible for any errors or omissions.

SCHRADER reserves the right to correct any such errors or omissions as soon as said errors or omissions are brought to its attention.

The images or videos appearing on the Site are for information purposes only and thus have no contractual value.

The information and/or documents available on the Site are subject to change at any time and may have been updated.

In particular, they may have been updated between the moment they were downloaded and the moment the User consulted them.

The use of the information and/or documents available on this Site, and in particular their downloading, is the sole responsibility of the User, who assumes all of the possible consequences, without SCHRADER’s responsibility being called into question, and without any recourse against the latter.

In no event shall SCHRADER be liable for any damages whatsoever resulting from the interpretation or use of the information and/or documents available on the Site.

The User undertakes not to send messages to SCHRADER (by email or by post) containing vulgar, racist or pornographic content or violating the privacy of a third party.

The User undertakes not to intentionally or unintentionally introduce a virus or a file of any nature whatsoever that would disrupt the proper functioning of the Site.

SCHRADER reserves the right to take legal action against any malicious User.

Hyperlinks

The Site may contain hyperlinks to other sites on the Internet. These links cause the User to leave the Site.

In no event shall SCHRADER be held responsible for the availability of these resources or their content.

The User who wishes to create a simple link to the presentation page of the Site must obtain prior authorization from SCHRADER. Under no circumstances shall this link imply an affiliation agreement.

However, any hyperlink to the Site and using the technique of framing or in-line linking is strictly prohibited. In all cases, any link, even tacitly authorized, shall be withdrawn upon request by SCHRADER.

Cookies

A cookie is a small text file that is placed on the hard disk of the User’s computer (or other electronic means) when the latter accesses the Site. SCHRADER uses cookies on the Site to:

obtain information on the User’s preferences, his/her online navigation and use of the Internet;

Disabling cookies:

If the User does not wish to enable the cookies, he/she can modify the parameters of his/her browser so that the cookies are not accepted. Google Analytics

The Site uses Google Analytics, a web analytics service provided by Google Inc. (hereinafter referred to as "Google"). Any representation, reproduction, or partial or total use of the content and services offered by the Site, by any means whatsoever, without the prior written authorization of SCHRADER and/or its partners, is strictly prohibited and is liable to constitute an infringement under Articles L 335-2 and following of the French Code of Intellectual Property.

The “SCHRADER®” trademark is a registered trademark of SCHRADER SAS or one of its affiliates. Any representation, reproduction, or partial or total use of these trademarks, of whatever nature, is strictly prohibited.

Evolution of the General Terms and Conditions of Use

SCHRADER reserves the right to modify, at any time and without prior notice, the present Terms and Conditions of Use in order to adapt them to the evolutions of the Site.

Applicable law and jurisdiction

Both the present Site and the Terms and Conditions of its use are governed by French law, regardless of the place of use. Any dispute, whatever its nature or cause, and in the absence of an amicable settlement, will be exclusively subject to the competent courts under the jurisdiction of the Court of Appeal of Besançon, France, even in the case of a plurality of defendants or of the introduction of third parties. In the event that the Site and/or the Terms and Conditions of Use are translated into a language other than French, the French version shall prevail.
